Nicholas Marseÿ	\| Countÿ was Sumõned to answer unto Edward Steaphenson
	of a plea y^t he rend^r him y^e full & Just Sum^e of one

      thousand one hundred and Seventÿ pounds of good Sound Merchantable leafe
      tobacco & Cask which to him he oweth and from him he unjustlÿ Detaines
        And whereupon y^e S^d Edwd Steaphenson bÿ Richd Macklin his att^ry Complain’s
      that whereas y^e S^d Nicholas Marseÿ y^e 25^th Daÿ of 9ber anno Dñi 1702 att Kent Countÿ
      w^thin y^e Jurisdiction of this Court bÿ his Certaine bill or writeing obligatorÿ
      Sealed w^th his Seale as his act & Deed Delivered & here in Court brought whose
      Date is y^e Same Daÿ & year Did bind himselfe to his heires Ex^rs: adm^rs. to paÿ or
      Cause to be paid unto y^e S^d Edward Steaphenson or ord^r y^e afs^d Sum^e of 1170^ls of tob^o
      quallified as afs^d Convenient in S^d Countÿ yett notw^thstanding y^e S^d Nicholas
      Marseÿ y^e afs^d Sum^e of 1170^ls of tobacco according to y^e ten^r of y^e Same bill or write
   = ing obligatorÿ hath not paid but y^e Same to paÿ he hath Denÿed & refused
      and Still Doth Denÿ & refuse and unjustlÿ Detaine to y^e Damãge of y^e Said

Edwrd Steaphenson	\| Defends y^e force & Enjurÿ when &c^a and for plea Saÿeth
	\| true it is y^e Said Def^t Did Seale and Deliver y^e afs^d obligation
	for y^e Sum^e of one thousand one hundred & Seaventÿ pounds

      of tobacco as in y^e pltfs Declaⁿ is mentioned but further y^e S^d Def^t Saÿeth that
      a Certaine Edward ffreÿ late of S^d Countÿ Deceased, whose Debts y^e S^d pltf obliedged
      himselfe to paÿ &c^a Stood Indebted unto y^e S^d Def^t y^e Sum^e of Eight hundred –
      fourtÿ & Seaven pounds of tobacco as bÿ an acc^t to this plea annexed & here in
      Court brought appears for w^ch he praÿs alloweance according to act of assemblÿ
      and as to y^e residue being three twentÿ & three pounds of tobacco he y^e S^d Def^t
      Doth not Gainsaÿ:            Earle p^r Def^ce,
