      Conceived fitt & necessarÿ to be Done & Did reasonable Deserve for Doeing y^e Same
      y^e Sum^e of two thousand pounds of good tob^o yett y^e S^d Phillip his promiss and assu=
     :mption afs^d little regarding but plotting & fraudulentlÿ Intending him y^e S^d
      David of y^e afs^d 200^ls of tob^o Craftÿlÿ to Deceive & Defraud y^e Same 2000^ls of tob^o or
      anÿ part thereof to him y^e S^d David, altho’ often required according to his p^rmiss & —
      assumption afs^d y^e S^d Phillip hath not paid or to him y^e S^d David in anÿ manner
      for y^e Same Contented but y^e Same to him hitherto to paÿ altogether refused &

     &c^a afs^d p^rcept y^e Sher^f makes return y^t he has here readÿ twelve &c^a as bÿ his S^d p^rcept he
     was Comãnded to witt, Tho: Cook, John Thorp, Char: Newman, Tho: Scottin, Ralph Arnold,
     Jn^o ffannen, Nicholas Marseÿ, W^m: Robinson, W^m: Parks, Tho: Godwin Mathew Dowlar,
     Peter Peterson, who being Duelÿ Ellected and Sworn to Saÿ y^e truth in y^e p^rmises
     Doe Saÿ upon their oathes wee of y^e Jurÿ find for y^e Def^t
     It is therefore Considered here bÿ the Court this Daÿ to witt y^e 23^th Daÿ of
     9ber an^o 1703 that y^e S^d pltf take nothing bÿ his writt afs^d but be in mercÿ
      for his falce Clamour, & y^t y^e S^d Def goe thereof w^thout Daÿ, And it is
      likewise Considered bÿ y^e S^d Court y^e Same Daÿ & year y^t y^e S^d Def^t recover
       a^t y^e S^d pltf as well y^e Sum^e of fiftÿ pounds of tob^o for a no Suit as y^e ~
       Sum^e of three hundred & Eightÿ pounds of tob^o his Cost of Suit laid out
