      next Court to witt this twentÿ fourth Daÿ of August anno Dñi 1703 –
      Comes | as well ) the Said pltf bÿ his Said att^rÿ as the Said Defend^t bÿ his S^d
      Att^rÿ who Defends y^e force & Injurÿ and fo^r plea Saÿeth    —
                     That he is not Guiltÿ of this he putts himself upon
      The Countrÿ                                                    Macklin p^r Def^ce ~ ~ ~~
                     And the pltf in like man^r Earle p^r q^r

           Thereupon Comand was Given to the Sher^f of ^ that he Imediatlÿ Cause
      to Come here twelve &c^a: bÿ whom &c^a who neither &c^a to recognize &c^a: The Cause
      as well &c^a ~~ And the Said ^^{She^r} makes retⁿ of his Said p^rcept, and Saÿeth that
      he has here readÿ twelve according to his Said p^rcept as he was Comanded –
      (to Witt) John Davis &c^a: as in the foregoeing action p^rticularlÿ nomi~
      nated who being Elected trÿed & Sworne to Saÿ y^e truth in the p^rmisses ~~
      And have heard y^e pleadings and Allegations on both Sÿdes Doe Saÿ upon ~~
      their oathes we of y^e Jurÿ Doe finde for the Defend^t:
      Which being bÿ the Court ^^heard and unsterstood It is bÿ them Considered (this
      twentÿ fourth Daÿ of August anno Dñi 1703 ) That y^e Said Defend^t recov^r
      against y^e Said pltf | as well ) as y^e Sum^e of fiftÿ pounds of tob^o for a ~
      nonsuit as the                                                    Cost of Suit accrew=

a^t	\| in Marÿland	\| answer unto John Worth of y^e Same Countÿ
Charles ffloÿde	\|	\| of a plea of trespass upon y^e Case —

      And Whereupon the Said John bÿ Mic^ll Earle his att^rÿ Complains and Saÿeth
      that whereas in the year of our Lord xpt 1701 in Said Countÿ w^thin y^e Jurisdic=
   = tion of this Court att the Speciall Instance & request of y^e Said Charles the
      Said John Sold & Delivered unto him y^e Said Charles Divers goods warres and
      merchandizes; & allsoe att y^e like Instance & request in the afores^d year w^thin
      y^e Jurisdiction afores^d y^e Said Joⁿ Did Cause one of his Serv^ts: to work
      for Said Charles Dev^rs: Daÿs all which Said goods warr’s & merchandizes Sold
      and Delivered & work Done app^rs bÿ an acc^t to this Declⁿ annexed and here
      in Court produced amõunting in the whole to y^e. Sum^e of twelve hundred ~
      thirtÿ five pounds of tobacco, In Consideration Thereof the Said Charles upon
      himselfe assumed and unto the Said John faithfullÿ promissed that he y^e
      Said Charles the aforesaid Sum^e of 1235^ls tob^o unto the Said John he would well
      and truelÿ paÿ when thereunto afterwards required Yett nevertheless the y^e S^d
      Charles his promisse & assumption before made not minding nor regarding
      but plotting Contriveing and fraudulentlÿ Indending him y^e Said John in this
      behalfe Craftÿlÿ & Subtilelÿ to Deceive and Defraud y^e afores^d 1235^ls tob^o ~
      to paÿ he hath Denÿed & refused and Still Doth Denÿ & refuse & unjustlÿ
      Detaine to y^e Damage of y^e Said John 2400^ls tob^o & thereupon he ~~
      he brings this Suite      Earle    p^r q^r Pledges &c^a: Joⁿ Doe Roe —
      And now here this Daÿ to witt y^e twentÿ fifth Daÿ of November anno Dñi
      1702 Comes y^e Said Defend^t bÿ Richard Macklin his att^rÿ & Defends y^e force
      and Injurÿ when &c^a: and praÿs leave to Imp^rle untill next Cou^rt
