18)   Admrs as afd Since their Espousall paid the Said five Thousand Six hundred pounds of tobo.
      altho often Required thereunto but the Same to pay hath denyed and Still doth unjustly detaine to the
      Damage of the Said James Wroth 11200lb of Tobacco and thereupon he brings this Suit

      And the Said Thomas And Anne ^ In their afd Capacity by Michael Earle their Attorney comes and
      defends the force and injury when &ca. And prays Oyer of the Condition of the aforementioned
      Obligation and it is read unto them in these words following Vizt.
      The Condition of the above Obligation is Such that if the above bounden Robert
      Devenish his heires Exrs. admrs. do pay or Cause to be paid unto the abovesd. James Wroth
      his heires Exrs Admrs or Assignes the full and Just Sume of two thousand Eight hundred
      and three pounds of tobacco one third at or before the tenth day of November next Ensuing
      the date hereof that then the above Obligation Shall be void and of none Effect
      Else to remaine and be in full power force and Virtue ———

The Admrs. of Devenish    And the Said Admrs. in their Capacity by Michael Earle their Attry
ads. | Comes and defends the force and injury when &ca. And for plea Sayth that
James Wroth | that no process Issue nor other thing be done agt. the sd defendts for ^yt the Said
      Admrs. in their Said Capacity hath regularly paid diverse Sumes of Tobacco &ca. Amounting to

      which Tantamounts the Intestates Estate As Appeares by An Account hereunto Annexed and
      herein Court prduced and that they have nor had not Assetts of the Said intestates at the
      time of the plaintifs Commencing his Suit to pay or Satisfy the plaintifs demand nor any pt
      thereof All which they are ready to averr And therefore the Accon afd against the
      Said defendts. Ought not to be had or Maintained &ca. therefore prays Judgt. &ca. Earle pr defts
