James Wroth    |    Command was Given the Sherf of Kent County the Twenty thired day of Septr.
at    |    one thousand Seven hundred and one that he take Thomas Cooke and Anne
the Admr of    |    his wife Admrs. of all and Singular the goods and Chattells and credits of
Robt. Devnish    |    Robert Devnish late of Kent County planter deceased if found in his bay=

      : liwicke and them Safe keep So that he have their bodies before our Justices

      of the next Court to be held for the Said County the fourth Tuesday in Novem=

      next to Answer unto James Wroth of a plea that they render unto him

      the full and Just Sume of five thousand Six hundred pounds of good
Sound Merchantable leaf Tobacco and casq cleare of all manner of Trash &ca. at which
next Court vizt. the twenty fifth of November one thousand Seven hundred and one
the day of the returne of the Said writt Came Elias King high Sherf of Said County and made
retn thereof in these words Vizt. Cepi Corpus Elias King Sherf. And the Said cause now Standing
for tryall came as well the Said defendts: by their Said Attorney as also the plaintf. by his Said Attry
The Plaintf. Decln Vizt.       Kent Ss: Thomas Cooke and Anne his wife Admrs. of all and
Singular the goods Chattells and Credits of Robert Devenish late of Kent County planter deceased were
Sumoned to answer unto James Wroth of a plea that they render him the full and Just Sume of
five thousand Six hundred pounds of good Sound merchantable bright Tobacco in casq (whic Clear
of all manner of Trash which from him they unjustly detaine ~~
           And whereupon the Said James Wroth by Richard Macklin his Attorney Saith that
whereas the Said Robert Devenish in his life time the nine and twentyeth day of October
Anno Domini one thousand Six hundred ninety Eight At Kent County within the Jurisdiction
of this Court by his certain bond or writing Obligatory Sealed with his Seale as his act and deed
delivered and hereinto Court brought whose date is the day and year afd did become holden and firmly
bound unto the Said James Wroth in the afd Sume of five thousand and Six hundred pounds of
Tobacco qualifyed as afd to be paid to the Said James Wroth his Exrs Admr.s or Assignes to the
Which payment Well and truly to be made the Said Robert Devenish did bind himself his
heires Exrs and Admrs. firmly by the Said bond or writing Obligatory. Yet Nevertheless the Said
Robert Devenish in his life time the Said Sume of five thousand Six hundred pounds of Tobacco accord
ing to the tenr. of the Said Bond he hath not paid Neither hath the Said Anne when Sole Since the
Death of the Said Robert paid the Same Nor have they the Said Thomas Cooke and Anne his wife
