March Court 1702/3 and Chattells of a certaine John Primrose of the price of three hundred pounds of tobacco there being felloniously he did take and Kill against the peace of our Sovñ Lady the Queen and agt. the form of the act of Assembly in yt. Case made and provided. Macklin pr Dña Regã ~ which Sd Bill was Endored Billa vera pr Wm Comegys foreman~ ~ ~ ~ ~ And the Said John Ponder having been Called to the barr Appears and prays Tryall of the prmises this Court which being grted The Said John for plea to the Indictmt. afd Sayth that he is not guilty and thereof puts himself for Tryall upon his Cuntrey. And the Said Richd. Macklin who prosecutes for our Lady the Queen in like mañer Thereupon Comand is given the Sherf of Kent County that He imediatly Cause to Come here Twelve &ca. by whom who doth not &ca: to Recognize &ca. because As well &ca: And the Said Sherf retd his precept yt. he has here ready Twelve &ca. as by his Sd precept he was Comanded that is to Say Edward Plestoe Samll. Tovey John Fannen Geo: Smith Geo: Copper Rennatus Smith Thomas Godwin Thos: Tolley Wm. Sweatnam Charles Floyd John Meredith and Richard Mason who being Elected Tryed and Sworne to Say the truth in the premises do Say upon their oaths we of the Jury having heard the processe And pleading in this behalf do Say upon Our oaths we find the Deft. Guilty of the prmises. Which being by the Court heard And understood It is by them Considered That the Sherf of Kent County Immediately Take the Said John Ponder and put him in the Pillory according to custome, there to remaine for the Space of Two hours. and that after the Said Two hours expired He take him to the Whipping post and give him ten lashes on his bare back well laid on. and That the Said John Ponder Satisfy and pay unto the Sd John Primrose the Sume of Eight hundred pounds of tobacco for the forefold of the heifer afd being by this Court Adjudged to the price of two hundred pounds of tobacco & yt. the Said Jno. Ponder pay all Costs and Charges In this behalf accruing ~ ~~~~~~~~~~~~~~~ And the Sd Sherf having Executed the Corporall punishmt: as afd this twenty third day of March 1702 / the Sd. John was orderd to give Security for his appeare &ca. who thereupon Acknowled himself to Anne be Justly indebted unto her Sacred Majty Queen ^ in the Just Sume of twenty pounds Sterg | likewise Comes into Court Thomas Wyat and Nicho: Marsey and Acknowledge themselvs to be Srãlly bound as afd in the Sume of tenn pounds Sterg. the Said Srãll Sumes to be Levyed Respect- :ivly of their & evry of their goods and Chattells Lands and tenemts: to the use of her Said Majty her heires and Successors in Case the above bound John Ponder do not Make his prsonall Appearance At the next Court to be held for this County and in the meane time be of good behavr. and Abbeare &ca - |
