      there faithfully promised yt. he the Said Wm. Bateman
      would well and truly pay unto the Said Giles Bond the afd Sume
      of five thousand Six hundred and Sixty pounds of tobacco when
      thereunto afterwards by the sd. Giles Bond he Should be required —
      And Altho’ the Said Giles Bond upon the hope of the faithfull
      prformance of the prmise and Assumption of the afd Wm. Baitman
      on the afd twenty Seventh day Anno Dmi 1701 did Content & —
      pay unto the afd Robt. Smith the afd Sume of five thousand
      Six hundred and Sixty pounds of tobacco in the Said writt Contained
      And likewise procured An order from under the hand of the Said —
      Robert Smith to discharge the Said Wm. Bateman from the five
      thosd Six hundred and Sixty pounds of tobacco in the said Writts
      Menconed upon the Said Wm. Bateman to pay the Same unto —
      the Said Giles Bond Yet Nevertheless the said Wm. his promise
      and Assumption afd little regarding or minding but plotting
      Contriving and fraudulently intending him the Said Giles Bond
      in yt. behalf Craftilly and Subtilly to deceive and defraud the
      Afd Sume of five thousand Six hundred and Sixty pounds of tobo.
      According to his afd promise and Assumption unto the sd:
      Giles Bond altho’ often thereunto required hath not paid —
      but the Same to pay hath denyed and refused and Still doth
      deny and refuse to the damage of the Said Giles Bond 11320lb
      Tobacco and thereupon he brings this Suit    pleg &ca. Jno Doe Ri Roe
           And the Said Deft. by M Earle his Attry Comes and defends —
      the force and Injury when &ca prays leave to Imprle hereunto untill next
      Court which is granted him the Same day is given the plaintf Also ~
           At Which Said next Court to wit this twenty Second day of
      Septr. Anno Dmi 1702 Comes As well the plaintf by his Attry afd as
      the Said deft. by his Attry who for plea Sayth yt. he did not
      in his Decln hath Alledged and of this for tryall puts himself upon
      the Countrey ~ And the plaintf in like Manner~
           Whereupon Comand is given the Sherf of Kent County that he —
      Immediately Cause to Come here twelve &ca: by whom &ca. who neither
      &ca. to recognize &ca. because as well &ca:
                Who Sayth yt. he hath here ready twelve &ca. As by his precept
      It was Comanded to wit Thomas Covington Wm. Blay Alexr. Graves
      Rice Jones Benjn. Bond Stephen Whettston David Davison Robert
