Wm. Burroughs |    plea of Trespass upon the Case ~
      And Whereupon the Said John by Richard Macklin his Attry Complains
      that whereas the afd Wm. the tenth day of May Anno Dmi 1702:
      At Chester river in Kent County within the Jurisdiction of this –
      Court in Consideration yt. ye. Said John would prmitt his wife Agnis
      to use her Uttmost Skill and Endeavour to cure a Sore breast
      that Mary the wife of the Said William then had that then
      the Said Wm. upon himself Assumed and unto the Said John
      faithfully promised yt. he the Said Wm. for the Labours &
      pains and Endeavours of the Said Agnis wife of ye. Said John
      in yt. behalf to be taken As Also for Such Medecines as
      the Said Agnes wife of the Said John Should Apply to the Sd.
      Mary wife of the Said Wm. for the cure of her breast
      Would well and truly pay him ye. Said John As much good –
      tobacco as he the Said John for Such medecines as he the Sd.
      John’s wife Should Apply and for the labour and pains that
      She Should take Should reasonably deserve when thereunto after-
      :wards required and ye. Said John in fact Sayth yt. he giving
      Creditt to the afd promise and Assumption of the Said Wm.
      and relying thereon he did Suffer and prmitt Agnis his wife
      who did Apply Svrall things to the Said Mary’s Breast proper
      to Remove and cure yt. indisposition of her breast under wch.
      She then languished and the Said Agnis did Use her uttmost
      Skill care pains and Endeavr: to heale her the Sd. Mary’s Breast
      for all Which he the Sd. John Sayth he doth reasonably –
      deserve to have the Sume of five hundred pounds of tobacco
      As Appeares by An Account to this decln Annexed and here into
      Court brought Nevertheless the Said Wm. the afd five hundred
      pounds of tobacco according to his promise and Assumption afd made
      unto the Said John altho’ often demanded he hath not paid but
      the Same to him to pay he hath and Still doth deny and –
      refuse to the damage of the Said John Parsons 1000lb tobo. &
      thereupon he brings this Suit.    Pledges &ca. Jno Doe Ri Roe
           And the Sd. Plaintf produceth the acco. which follows
May ye. 10th. Wm. Burroughs Dr. 1702
           to the cure of your wifes breast - -    200

to Medecines and My Attendance - - - 300
