Section 140(e)
Annotated Code of Maryland
(1978 Replacement Volume and 1979 Supplement)

Preamble

WHEREAS, Chapter 295 of the Acts of 1978 gave the
Department of General Services' Special Police Officer force
the status of a regular police unit; and

WHEREAS, Chapter 295 made the Department of General
Services' Special Police Officer force subject to the
regulations and requirements of the Maryland Police Training
Commission; and

WHEREAS, The Training Commission has a requirement that
a person over the age of 35 years may not be hired or
promoted as a police officer; and

WHEREAS, This age restriction constitutes a barrier to
advancement for approximately 50 watchmen and guards who
were employed at the Department of General Services prior to
the effective date of Chapter 295; and

WHEREAS, Legislation is needed to correct the resulting
inequity which exists for a small class of State employees
who, through no fault of their own, are prevented from full
participation in the Maryland State employment system; now,
therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 41 - Governor-Executive and Administrative
Departments

140.

(e) (1) The Superintendent of Baltimore Public
Buildings and Grounds and the Superintendent of Annapolis
Public Buildings and Grounds shall provide and maintain a
security force for the facilities and properties which each
is responsible for maintaining and guarding. The purpose of
each force is to protect persons and property; to disperse
assemblages which are unlawful, dangerous, or obstruct full
and free passage; to control pedestrian or vehicular
traffic; and otherwise to preserve and to protect the public
peace, health, and safety. For these purposes, a member of
one of these forces is a peace and police officer and has
the same powers as sheriffs, constables, police, and peace
officers in their respective jurisdictions.
