SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article - Natural Resources
10-604.
(e) Any law to the contrary notwithstanding, neither
the Secretary of Natural Resources nor any other official of
the Department of Natural Resources may promulgate any rule
or regulation banning or limiting the use or possession of
lead shot ammunition while hunting wild waterfowl [more
restrictive than pertinent federal regulations]. Any rule
or regulation [promulgated prior to July 1, 1974, including
regulation 08.02.21.44, entitled "Use of lead shot,"
regardless of its effective date,] WHICH BANS OR LIMITS THE
USE OR POSSESSION OF LEAD SHOT AMMUNITION WHILE HUNTING WILD
WATERFOWL is declared null, void, and of no effect. NEITHER
THE STATE NOR ANY AGENCY OR DEPARTMENT MAY REQUEST THAT THE
FEDERAL GOVERNMENT ENFORCE ANY FEDERAL RULE OR REGULATION
REGARDING A BAN OR LIMIT ON THE USE OR POSSESSION OF LEAD
SHOT AMMUNITION.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.
Passed over the Governor's veto, in the Senate on January 9,
1980, and in the House of Delegates on January 11,
1980.
