(C) MARRIED APPLICANTS.

THE DOMICILE REQUIREMENT MAY BE SATISFIED BY EITHER OF
TWO SPOUSES APPLYING FOR A LOAN.

(3), and the first sentence of (3)(i), and as
Art. 41, § 266FF-2(c).

13-312. APPLICATIONS FOR LOANS.

(A) IN GENERAL.

(1)       TO APPLY FOR A LOAN, THE APPLICANT SHALL:

(I)       SUBMIT AN APPLICATION TO THE
DEPARTMENT ON THE FORM THAT IT REQUIRES; AND

(II)       PAY TO THE DEPARTMENT THE APPLICATION
FEE SET BY THE DEPARTMENT.

(2)       THE APPLICATION SHALL INCLUDE.

(I)       EVIDENCE THAT THE APPLICANT HAS
APPLIED FOR AND BEEN DENIED SIMILAR MORTGAGE FINANCING BY AT
LEAST TWO PRIVATE MORTGAGE LENDING INSTITUTIONS; AND

(II)       A COPY OF THE APPLICANT'S LATEST
STATE INCOME TAX RETURN THAT IS CERTIFIED BY THE STATE
COMPTROLLER'S OFFICE OR OTHER AVAILABLE VERIFICATION OF
INCOME.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the first clause
of the third sentence of Art. 41, § 266FF-2(a)
and from Art. 41, § 266FF-2(b)(3)(iii) and (iv).

Paragraph (1)(i) of this subsection is standard
language added to state expressly a provision
that now only is implied in the law; i.e., that
applications may be made only on the form
required by the Board.

As to the authority of the Department to set
fees, see § 13-306(h) of this subtitle.

As to the requirements for written notices of
rejection and their use in applications, see §§
5-507 and 9-902 of this article.
