(3) EXPENSES FOR ADMINISTRATIVE, LEGAL,

ACTUARIAL, AND OTHER SERVICES.

REVISOR'S NOTE: This section is new language derived
without substantive change from the last two
sentences of Art. 41, § 266HH-8(a)(1) and from
Art. 41, 266HH-9.

In subsection (b) of this section, the references
in present Art. 41, § 266HH—9 to the requisite
"approval" of the Secretary and the "annual
approval of the budget by the General Assembly"
are deleted as unnecessary in light of § 13-211
of this subtitle and the general rules relative
to the State's budgetary process.

13-221. ADDITIONS TO FUND.

(A)   REQUEST TO BOARD OF PUBLIC WORKS.

IF THE AUTHORITY AND THE SECRETARY FIND THAT MORE MONEY
IS NEEDED TO KEEP THE RESERVES OF THE FUND AT AN ADEQUATE
LEVEL, THE AUTHORITY SHALL SEND TO THE BOARD OF PUBLIC WORKS
A WRITTEN REQUEST FOR THE ADDITIONAL MONEY.

(B)   PAYMENT FROM EMERGENCY FUND.

THE BOARD OF PUBLIC WORKS MAY PAY THE AMOUNT REQUESTED
BY THE AUTHORITY UNDER THIS SECTION FROM ITS EMERGENCY FUND.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 41, §
266HH-11(a).

As revised, subsection (a) of this section
corrects an internal inconsistency in present
Art. 41, § 266HH-11(a), which first refers to the
opinion of "the Authority and the Secretary" as
to the need for additional money and, then, to a
reserve level considered adequate by "the
Authority".

13-222. EXCESS FUNDS.

(A) EXCESS OVER CURRENT NEEDS.

IF, AT ANY TIME, THE AMOUNT OF MONEY IN THE FUND
EXCEEDS THE AMOUNT THAT THE AUTHORITY CONSIDERS NECESSARY
CURRENTLY TO MEET ITS EXPENSES AND OBLIGATIONS, THE EXCESS
SHALL BE:

(1)   DEPOSITED WITH THE STATE TREASURER, TO THE
CREDIT OF THE FUND; AND

(2)   INVESTED IN THE MANNER PROVIDED FOR BY LAW.

(B) EXCESS OVER OBLIGATIONS.
