term of one of the appointed members of the
Authority expires in each year.

As to subsection (c) of this section, for other
provisions on removal, see: Art. XV, § 3 of the
State Constitution, on suspension and removal for
crimes; and Art. 41, § 4 of the Code, on removal
for failure to attend meetings.

The last sentence of present Art. 41, §
266HH-3 (e), which states that the ex officio
members "have all of the powers of a director",
is deleted as unnecessary since, absent express
provisions limiting their authority, ex officio
members are full members.

13-207. OFFICERS.

(A)   IN GENERAL.

FROM AMONG ITS MEMBERS, THE AUTHORITY SHALL ELECT A
CHAIRMAN, VICE CHAIRMAN, AND TREASURES.

(B)   ELECTIONS AND TERMS OF OFFICE.

THE MANNER OF ELECTION OF OFFICERS AND THEIR TERMS OF
OFFICE SHALL BE AS THE AUTHORITY DETERMINES.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
the third sentence of Art. 41, § 266HH-3(d) —
except as that sentence relates to the executive
director of the Authority.

Subsection (b) of this section is new language
added for clarity.

The fourth sentence of Art. 41, § 266HH-3(d),
which requires the secretary and the treasurer to
be bonded, is deleted as unnecessary since, in
fact, all State employees and officers are
covered by a blanket bond.

13-208. EXECUTIVE DIRECTOR.

(A)   POSITION AND APPOINTMENT.

THE AUTHORITY, WITH THE APPROVAL OF THE SECRETARY OF
ECONOMIC AND COMMUNITY DEVELOPMENT, SHALL APPOINT AN
EXECUTIVE DIRECTOR, WHO IS THE CHIEF ADMINISTRATIVE OFFICER
AND SECRETARY OF THE AUTHORITY.

(B)   RESPONSIBLE TO AUTHORITY.

THE EXECUTIVE DIRECTOR SERVES AT THE PLEASURE OF THE
AUTHORITY, BUT MAY NOT BE REMOVED WITHOUT THE CONCURRENCE OF
THE SECRETARY OF ECONOMIC AND COMMUNITY DEVELOPMENT.
