(B) CONFIDENTIALITY; ANALYSES OR RECAPITULATIONS.

THE BANK COMMISSIONER:

(1)   SHALL KEEP CONFIDENTIAL THE ANNUAL REPORT OF
EACH LICENSEE;

(2)   MAY PUBLISH ANY ANALYSIS OR RECAPITULATION
OF THE ANNUAL REPORTS OF LICENSEES; AND

(3)   MAY MAKE THIS ANALYSIS OR RECAPITULATION
AVAILABLE FOR PUBLIC EXAMINATION.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 66, § 59.

In subsection (a)(3) of this section, the phrase
"signed and verified" is substituted for the
requirement that the report be "under oath". See
§ 1-202 of this article.

In subsection (b)(3) of this section, reference
to "public" examination is added for clarity.

12-312. LICENSEE TO KEEP BOOKS AND RECORDS.

EACH LICENSEE SHALL KEEP AND MAKE AVAILABLE TO THE BANK
COMMISSIONER AT THE LICENSEE'S PLACE OF BUSINESS ANY BOOKS
AND RECORDS THAT THE BANK COMMISSIONER, BY RULE OR
REGULATION, REQUIRES TO ENABLE THE BANK COMMISSIONER TO
ENFORCE THE MARYLAND SECONDARY MORTGAGE LOAN LAW.

12-313. VOLUNTARY SURRENDER OF LICENSE.

(A)   SURRENDER.

A LICENSEE MAY SURRENDER A LICENSE BY SENDING TO THE
BANK COMMISSIONER THE LICENSE AND A WRITTEN STATEMENT THAT
THE LICENSE IS SURRENDERED.

(B)   LIABILITY NOT AFFECTED.

THE SURRENDER OF A LICENSE DOES NOT AFFECT ANY CIVIL OR
CRIMINAL LIABILITY OF A LICENSEE FOR ACTS COMMITTED BEFORE
THE LICENSE HAS SURRENDERED.
