LAWS OF MARYLAND

Ch. 33

and from the first clause of § 32(d).

In subsection (b) (1) of this section, the present
reference to "each existing ... office or
terminal" is deleted as obsolete.

As to the authority of the Bank Commissioner to
set the application fee, see § 12-211 of this
subtitle.

As to the introductory clause of subsection (a)
of this section, the substitution of "an office
or electronic terminal" for the phrase "one or
more offices or terminals" is a style change and
does not preclude one application for several
offices and terminals. See Art. 1, § 8 of the
Code for the general rule of construction that
the singular includes the plural.

12-209. ISSUANCE OF PERMIT.

ON APPLICATION FOR A PERMIT, THE BANK COMMISSIONER
SHALL ISSUE THE PERMIT, IF THE BANK COMMISSIONER DETERMINES
THAT THE ESTABLISHMENT AND OPERATIONS OF THE PROPOSED OFFICE
OR ELECTRONIC TERMINAL WILL NOT VIOLATE ANY LAW OF THIS
STATE THAT APPLIES TO BANKS AND BANKING.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of Art. 11, § 32(c).

The present requirement for a determination that
there will be no violation of present Art. 11, §
31A is deleted as unnecessary, in light of the
prohibition against violation of "any law of this
State".

Present Art. 11, § 31A (a) now appears in §
12-207(b) of this subtitle.

12-210. TERM AND RENEWAL OF PERMIT.

(A)       TERM.

A PERMIT EXPIRES ON THE SECOND ANNIVERSARY OF ITS
EFFECTIVE DATE, UNLESS THE PERMIT IS RENEWED FOR A 2-YEAR
TERM AS PROVIDED IN THIS SECTION.

(B)       APPLICATIONS FOR RENEWAL.

BEFORE ITS PERMIT EXPIRES, THE FOREIGN BANK BANKING
CORPORATION MAY RENEW THE PERMIT FOR ADDITIONAL 2-YEAR TERMS
IF THE FOREIGN BANK BANKING CORPORATION:
