11—221. INTERPRETATION AND CONSTRUCTION OF SUBTITLE.

THIS SUBTITLE SHALL BE INTERPRETED AND CONSTRUED TO
EFFECTUATE ITS GENERAL REMEDIAL PURPOSE.

11-222. PENALTIES.

ANY PERSON WHO VIOLATES ANY PROVISION OF § 11-204(A) OF
THIS SUBTITLE {LICENSE REQUIRED} IS GUILTY OF A MISDEMEANOR
AND ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $5,000
OR IMPRISONMENT NOT EXCEEDING 3 YEARS OR BOTH.

Note that this section applies only to violations
of § 11—204(a) of this subtitle, which requires a
person to be licensed before the person may
engage in certain loan transactions. There is no
criminal penalty for violation of the many other
requirements and prohibitions, express or
implied, in this subtitle: e.g., the requirement
of § 11-214(b) that any person who makes a loan
—whether or not that person acts or claims to
act under the Maryland Consumer Loan Law — must
give the Commissioner access to any books,
papers, records, safes, or vaults. The General
Assembly may wish to consider this question.

THIS SUBTITLE MAY BE CITED AS THE MARYLAND CONSUMER
LOAN LAW — LICENSING PROVISIONS.

(B)   MARYLAND CONSUMER LOAN LAW.

THIS SUBTITLE AND THE MARYLAND CONSUMER LOAN LAW —
CREDIT PROVISIONS MAY BE CITED JOINTLY AS THE MARYLAND
CONSUMER LOAN LAW.
