THE DIVISION DIRECTOR SERVES AT THE PLEASURE OF THE
SECRETARY.

(D) COMPENSATION.

THE DIVISION DIRECTOR IS ENTITLED TO THE SALARY
PROVIDED IN THE STATE BUDGET.

REVISOR'S NOTE: This section is new language derived
without substantive change from the fifth through
the eighth sentences and the last clause of the
last sentence of Art. 23, § 161G(a) and from Art.
23, § 161E(e)(2).

As to subsection (a)(2) of this section, the
present phrase "unexpired portion of the term" is
deleted as misleading since the Director has no
set term.

In subsection (b)(2)(i) of this section, the
phrase "foreign or Maryland" is added to make
clear that experience with an association of
another state is acceptable. This result is
derived from Ch. 194, Acts of 1978, which deleted
the former provision that required the Division
Director's experience to have been only with a
State—chartered association.

As to subsection (b)(2)(ii) of this section, the
term "state" is used in the generic sense and
means of any state, as defined in § 1—101 of this
article.. This is a result of Ch. 194, Acts of
1978, which deleted the phrase "chartered or
incorporated under the laws of Maryland", that
had modified "association".

The provisions in present Art. 23, § 161E(e) (2)
that relate to selection of candidates for the
original Division Director are deleted as
obsolete. This deletion corrects an inadvertent
discrepancy as to the number of names to be
submitted to the Secretary as nominees. Although
present Art. 23, § 161E(e) (2) requires a list of
five names, present Art. 23, § 161G(a) was
amended by Ch. 194, Acts of 1978 to provide that
only three names be submitted to the Secretary.
The Commission adopts the procedure of three
names set forth in present Art. 23, § 161G(a) as
being the later enactment.

Note that, as a practical matter, the Division
Director carries out the policies and administers
the rules and regulations set by the Board of
Commissioners. Both the Board of Commissioners
and the Division are within the Department of
Licensing and Regulation, and the Division is
