Bill No. 44-79

AN ACT to change the time the first payment is due on
water, sewerage or drainage construction charges annually
assessed upon property owners, by repealing and re-enacting
with amendments Section 34-53 of Article III. Metropolitan
District, title "Water, Sewers, Sewage Disposal, and
Drains", of the Baltimore County Code, 1968.

Bill No. 46-79

AN ACT to provide the procedures whereby the Board of
Appeals exercises original and exclusive jurisdiction over
all petitions for reclassification of property; suspension
of reclassification petition filing to provide guidelines
and conditions relating to reclassification, and to provide
for transfer to the board of appeals of reclassification
petitions pending before the zoning commissioner, by
repealing Sections 22-22 and 22-22.1 of Article III.
Zoning, title "Planning, Zoning and Subdivision Control" of
the Baltimore County Code, 1968, as amended, and adding new
Sections 2-40.1 and 2-40.2 to Article V. Board of Appeals,
title "Administration" of said Code, and by repealing and
reenacting with amendments Section 22-23 of Article III.
Zoning, title "Planning, Zoning and Subdivision Control" of
said code.

WHEREAS, by Council Bill No. 85-78, adopted by the
voters of the County on November 7, 1978, Section 602 of the
Charter confers upon the County Board of Appeals original
and exclusive jurisdiction over all petitions for
reclassification; and

WHEREAS, by Section 606 of the Charter, the County
Council has the power to enact furthering legislation, not
inconsistent with the provisions of Article VI of the
Charter, to implement and define the powers and functions of
the County Board of Appeals as specified in said article;
and

WHEREAS, by County Bill No. 83-78, adopted by the
voters of the County on November 7, 1978, Section 524 of the
Charter empowers the County Council, by legislative act, to
define the duties of the director of the office of planning
and zoning and to establish the powers and duties of the
planning board; now, therefore
