3466                                     EXECUTIVE ORDERS

HEREIN, [PROCLAIM AND ISSUE] THE FOLLOWING ORDER,
EFFECTIVE IMMEDIATELY:

1.  No SALE OR purchase of gasoline for a vehicle
shall be made for less than five dollars, if the
vehicle contains less than six cylinders or, for
less than seven dollars, if the vehicle contains
six cylinders or more. Minimum purchase
requirements shall not apply to motorcycles or
mopeds as defined in Sections 11-136 and 11-130.1
of the Transportation Article or to container
sales as referred to in paragraph 2 below[.], OR
TO ANY VEHICLE HAVING A FUEL TANK CAPACITY OF
EIGHT GALLONS OR LESS.

2.  Not more than 2 gallons of gasoline may at
anytime be sold or purchased for delivery into a
container other than the fuel tank of a vehicle
to be transported away from the premises of the
retail seller. Nothing in this paragraph shall
be construed to authorize the sale of gasoline in
any container not satisfying applicable safety
requirements.

3.  No gasoline storage tank shall be constructed
at, and no gasoline shall be delivered into a
storage tank situated at any property utilized
SOLELY [and zoned for use] as a personal
residence.

4.  Any violation of this Order shall be
punishable as a misdemeanor and shall subject the
offender to a fine of not more than one hundred
dollars ($100.00) or not more than sixty day
incarceration, or both, upon conviction thereof.
Pursuant to my constitutional authority to nolle
prosse criminal charges and to grant reprieves
and pardons provided in Article II, Section 20 of
the Constitution of Maryland, I hereby direct the
police and prosecuting officials of the State and
local governments not to prosecute technical
violations of this Order occasioned by
[emergency] LIFE THREATENING situations.

5.  IN THE ALTERNATIVE, THE MOTOR VEHICLE
ADMINISTRATOR IS AUTHORIZED, AFTER APPROPRIATE
NOTICE AND ADMINISTRATIVE HEARING ONLY, TO ASSESS
POINTS AGAINST INDIVIDUAL OPERATORS AS FOLLOWS:

(I)  THE FIRST VIOLATION OF THIS EXECUTIVE
ORDER..............................1 POINT;

(II)  THE SECOND VIOLATION OF THIS
EXECUTIVE ORDER...................2 POINTS;
