House Bill No. 1213

AN ACT concerning

Juveniles - Psychiatric Commitment

FOR the purpose of providing that the court may commit a

child for emergency or other psychiatric

hospitalization based on certain findings; providing
for the commitment procedure; providing for duties of

the superintendent of the facility; providing a

procedure for an alternative disposition to a mental

health commitment; and generally relating to the

psychiatric commitment of children a child may be
committed to certain mental health facilities under
certain conditions; requiring a committing court to
make certain findings and conduct certain hearings; and
generally relating to the commitment of juveniles to
certain mental health facilities.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill 1213.

This bill provides that the court may place a child in
an emergency facility on an emergency basis if there is no
less restrictive alternative and if the child has a mental
disorder, is unable or unwilling to be voluntarily committed
and needs inpatient treatment for himself and others.

Senate Bill 160, which was enacted by the General
Assembly and signed by me on May 27, 1980 accomplishes the
