Ch. 883

[(b) (1)] (C) The petition filed pursuant to
subsection (b) OF THIS SECTION shall contain the following:

[(i)] (1) The name, title and address of the
petitioner, and his relationship to the alleged DRUG addict
OR DRUG ABUSER.

[(ii)] (2) The name, address, telephone number
(if any), birth date, birth place, age, sex, marital status,
occupation, and a physical description of the [person
believed to be a] ALLEGED drug addict OR DRUG ABUSER.

[(iii)] (3) Statements supporting the belief
that the [person] alleged [to be addicted] DRUG ADDICT OR
DRUG ABUSER is in fact a drug addict OR DRUG ABUSER as
defined in this article.

[(iv)] (4) A statement that the [person believed
to be a] ALLEGED drug addict OR DRUG ABUSER is in need of
care, supervision and treatment [on an inpatient basis].

[(b) (2)] (D) When [such] a petition is presented
PURSUANT TO SUBSECTION (B) OF THIS SECTION, the court may
examine the petitioner or any witness under oath and shall
determine [whether] IF there are reasonable grounds to
believe that the [person in whose behalf such application is
made] ALLEGED DRUG ADDICT OR DRUG ABUSER is a drug addict OR
DRUG ABUSER. If [the] AN ALLEGED DRUG ADDICT IS NOT THE
PETITIONER AND THE court determines that there are
reasonable grounds to believe that [such person] THE
INDIVIDUAL is a drug addict [and if such person is not also
the petitioner, it], THE COURT shall issue an order in
accordance with subsection [(b)(3)] (E) of this section.
When the alleged DRUG addict OR DRUG ABUSER is the
petitioner and the court determines that there are
reasonable grounds to believe that such person is a drug
addict OR DRUG ABUSER, the court shall immediately proceed
in accordance with subsection [(b)(5)] (F) of this section.
The state shall be a party in all proceedings pursuant to
this section [and shall act on the relation of the
petitioner]. The State's attorney shall represent the
State.

[(b) (3)] (E) (1) An order issued pursuant to this
[section] SUBSECTION shall direct [the] AN alleged drug
addict to appear at a specified time before the court for a
determination whether there are reasonable grounds to order
him to undergo a medical examination at a facility
designated by the [Authority] ADMINISTRATION. The court
shall direct that such order and petition be served upon the
alleged drug addict personally or by registered mail and the
court may further direct that such order and petition be
served personally or by mail upon the [husband or wife,
father or mother, or next of kin of such alleged drug
addict] PETITIONER.
