parent, legal guardian or next of kin, [such] THE
application may be made on behalf of [such person] THE
INDIVIDUAL by [such] THE parent, legal guardian or next of
kin. If [it be] IN the judgment of the [superintendent]
DIRECTOR of such public facility [that], it is in the best
interest of [any such] THE drug [addict] ABUSER, he may be
retained [therein] for a period not exceeding thirty days
for the purpose of care and treatment. At any time after ten
days from the date of admission of any [such] drug [addict]
ABUSER to [such] THE public facility [the superintendent]
ITS DIRECTOR may discharge [any such] THE drug [addict]
ABUSER who has recovered or who is deemed not suitable for
treatment in [such] THE facility; however, this provision
shall not preclude [such] THE patient from filing a petition
pursuant to § 9 of this article.

8.

Any rehabilitation center, medical examination
facility, or [such] other facility [or facilities as may be]
established and operated OR CONTRACTED TO BE OPERATED by the
[Authority] ADMINISTRATION pursuant to the provisions of
this article [shall be mental hygiene facilities within] IS
A HEALTH FACILITY UNDER the Department of HEALTH AND Mental
Hygiene and IS not [deemed] A correctional [facilities]
FACILITY for any purpose.

9.

(a)  A judge of the Supreme Bench of Baltimore City or
of the circuit court of the various counties or of the
District Court who has jurisdiction within the judicial
district where an alleged drug [addict, as defined in this
article,] ABUSER resides or [where he] may be found[,] may
certify [such] THE drug [addict] ABUSER in a civil
proceeding to the care and custody of the [Authority in the
manner hereinafter] ADMINISTRATION AS provided[; except that
no person] IN THIS SECTION. HOWEVER, AN INDIVIDUAL WHO
presently IS committed to the care and custody of the
[Authority] ADMINISTRATION under court order, [and no
person] who has pending against him any criminal action or
proceeding [and no person] OR WHO presently IS confined in a
correctional institution, [shall] MAY NOT be certified to
the [Authority] ADMINISTRATION pursuant to this section.

(b)  Any [person] INDIVIDUAL believing himself to be a
drug [addict] ABUSER, or the husband [or], wife, father
[or], mother, brother [or], sister, [or the] child, or [the]
nearest relative of [the] AN alleged DRUG addict, or anyone
residing in the same house of an alleged DRUG addict, or any
physician who believes that [a person] AN INDIVIDUAL is a
drug addict may apply for an order certifying [such person]
THE INDIVIDUAL to the care and custody of the [Authority]
ADMINISTRATION by presenting a verified petition to the
appropriate court.
