(2)  "DRUG ABUSER" INCLUDES A DRUG ADDICT.

(3)  "DRUG ABUSER" DOES NOT INCLUDE ANY
INDIVIDUAL SOLELY BY REASON OF HIS TAKING A DRUG UNDER A
LAWFUL PRESCRIPTION THAT A PHYSICIAN ISSUES FOR A LEGITIMATE
MEDICAL PURPOSE IN THE COURSE OF PROFESSIONAL TREATMENT.

[(e)] (F) "Drug addiction" means a physical and
psychological dependence on any [drug enumerated in]
CONTROLLED DANGEROUS SUBSTANCE, THE USE OF WHICH EITHER IS
PROHIBITED OR REGULATED BY §§ 276 through 302 of Article 27.

[(f)] (G) (1) "Drug addict" means a person exhibiting
the symptoms of drug addiction or who by reason of the
repeated use of any [drug enumerated above] CONTROLLED
DANGEROUS SUBSTANCE, THE USE OF WHICH EITHER IS PROHIBITED
OR REGULATED BY §§ 276 THROUGH 302 OF ARTICLE 27, is in
imminent danger of becoming addicted to that drug[;
provided, however, that no person shall be deemed a drug
addict].

(2) "DRUG ADDICT" DOES NOT INCLUDE ANY
INDIVIDUAL solely by virtue of his taking of any such drug
pursuant to a lawful prescription issued by a physician FOR
A LEGITIMATE MEDICAL PURPOSE in the course of professional
treatment [for legitimate medical purposes].

(H) "DRUG DEPENDENCY" MEANS A PSYCHOLOGICAL NEED FOR
ANY CONTROLLED DANGEROUS SUBSTANCE THE USE OF WHICH EITHER
IS PROHIBITED OR REGULATED BY §§ 276 THROUGH 302 OF ARTICLE
27.

[(g)] (I) "Narcotic drugs" means those drugs so
defined in § 277(g) of Article 27.

[(h)] (J) "Nonnarcotic drugs" means those drugs
enumerated in §§ 276 through 302 of Article 27 which are not
narcotic drugs.

3.

(a) There is [hereby created and established a council
to be known as the] AN Advisory Council on Drug Abuse, to
consist of the State Superintendent of Schools, the
[commissioners of] ASSISTANT SECRETARY FOR Mental [Hygiene,]
Health AND ADDICTIONS, THE COMMISSIONER OF Labor and
Industry, [and] THE COMMISSIONER OF Correction, the
[Secretary] DIRECTOR of [the Department of] Parole and
Probation, the chairman of the [State] MARYLAND Parole
[Board] COMMISSION, THE DIRECTOR OF THE JUVENILE SERVICES
ADMINISTRATION, the Director of the DRUG ABUSE
Administration, and the mayor of the City of Baltimore, each
to serve as permanent ex officio members and nine members to
be appointed by the Governor, from the general public. One
of the members from the general public shall serve as
chairman and one such member shall serve as vice-chairman
upon designation by the members of the Council. Each of the
