Article; granting the Authority the power to acquire,
construct, reconstruct, rehabilitate, maintain, equip,
lease, repair, and operate certain waste disposal and
energy generation projects; granting the Authority the
power to issue bonds, including bond anticipation
notes, grant and revenue anticipation notes and
industrial development revenue bonds for any corporate
purposes, including the financing of such projects;
granting to the Authority the power to take and hold
title to any project transferred to the Authority and
to assume the obligations or indebtedness of the
transferring subdivision incurred in connection with
such project; granting to the Authority the power to
enter into contracts, certain of such contracts to be
deemed for the benefit of certain bondholders;
providing for the Authority to receive loans and grants
and to participate in waste disposal, energy generation
and resource recovery programs; providing for the
Authority to make loans to subdivisions or other
persons from the proceeds of its revenue bonds in order
to provide projects authorized by the Authority;
authorizing the Authority to establish rules and
regulations with respect to its projects and operations
and to fix, charge, and collect rates, rentals, fees,
and charges in connection with projects authorized by
the Authority; granting the Authority the power to do
all things necessary or convenient to carry out its
purposes and exercise the powers granted under the Act;
providing that the Authority be authorized in
connection with the issuance of its bonds to pledge the
full faith and credit of the Authority; providing that
the bonds of the Authority shall not be deemed to
constitute a debt or liability of the State of Maryland
or any political subdivision thereof; providing that
the Authority be exempt from payment of any taxes or
assessments in respect to any project or any property
acquired or used by the Authority; providing that any
bonds issued under the provisions of this Act shall be
free from taxation of every kind by the State of
Maryland, its municipalities, and all other political
subdivisions thereof; authorizing certain political
subdivisions to enter into certain contracts with the
Authority; providing that, for certain purposes, these
contracts will not be deemed to be or to create a debt
of the subdivision, a pledge of its faith and credit,
or a capital project; and exempting these contracts
from certain referenda and procedures; providing that,
unless otherwise prohibited by contractual agreement, a
subdivision may contract with the Maryland
Environmental Service for the provision of any project;
providing for the Authority to issue refunding bonds;
providing that the Authority make an annual report to
the Governor and to the participating counties;
providing that the Authority shall not be deemed to be
a public service company; requiring the Authority to
obtain an affirmative statement from to notify the
board of county commissioners, city council, or county
