AN ACT concerning

Public School Construction Program -
Payment of Debt Service - Closed Schools

FOR the purpose of requiring the State to continue to pay
the debt service of certain public school construction

program facilities under certain conditions; and

requiring a county to reimburse the State for a certain
public school construction program facilities under
certain conditions.

BY adding to

FOR the purpose of providing that a county is not required
to reimburse the State for debt service resulting from
State funding of a public school which is now used for
purposes other than public education; providing that a
county may be required to reimburse the State for debt
service resulting from State funding for certain public
schools now used for certain purposes other than public
education; and specifying the conditions for this
provision.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Education

5-301.

(j) (4) THE STATE SHALL PAY THE DEBT SERVICE

FOR ANY FACILITY, FINANCED UNDER THE PUBLIC SCHOOL

CONSTRUCTION PROGRAM, THAT IS BEING USED FOR A PUBLIC
PURPOSE BY THE STATE OR A COUNTY.

(5) WHEN A FACILITY, WHOSE DEBT SERVICE IS BEING
PAID UNDER THE PUBLIC SCHOOL CONSTRUCTION PROGRAM, IS USED
NO LONGER FOR A PUBLIC PURPOSE, THE COUNTY SHALL PAY TO THE
