Preamble
Mrs. Daisy Alice Marsburn McGrath, 47, of Bowie,
Maryland retired on July 1, 1977 after 20 years of service
as a teacher in Maryland, and died eight days later. Under
former Article 77, § 195(8) of the Annotated Code of
Maryland death benefits or an allowance based on her
retirement contributions could not be paid because Mrs.
McGrath's death was within 30 days of her retirement.
Had Chapter 504 of the Acts of 1978 (Article 73B, §
86(8)) been in effect on the date of Mrs. McGrath's
retirement, benefits could have been paid to her heirs under
the Maryland State Teachers' Retirement System; now,
therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Board of Trustees of the Maryland State
Teacher's Retirement System shall pay to Barbara Laurene
McGrath and Brenda Alyce McGrath of Bowie, Maryland, a sum
equivalent to the death benefits or allowance they would
have been entitled to had Chapter 504 of the Acts of 1978
been in effect on the date of the retirement of Mrs. Daisy
Alice Marsburn McGrath, their mother. section(s) of the
Annotated Code of Maryland be repealed, amended, or enacted
to read as follows:
Article 73B - Pensions
11.
(11) (a) (I) In lieu of the disability or service
allowances payable under the aforesaid provisions, any
member may, prior to the first retirement allowance payment
normally due, elect a retirement allowance of equivalent
actuarial value in one of the optional forms set out below.
The election of the option shall be made on a form provided
for that purpose and shall be filed with the board of
trustees. If a member dies prior to the effective date of
retirement, the election shall be void and of no effect, and
