(c)  Contracts for development work that is not
susceptible to accurate bidding may be awarded by
negotiation.

(d)  (1) For all project contracts costing $500,000 or
more the Administration is considered a "public body" under
Article 100, § 96 (d) of the Code, whether or not the
projects are publicly funded and regardless of the source of
the funding.

(2) Whenever it is considered a "public body,"
the Administration shall comply with all the requirements
for public bodies set forth in Article 100, Subtitle
"Contracts for Public Works."]

7-208.

(a)  Subject to the authority of the Secretary and,
where applicable, the Maryland Transportation Authority, the
Administration has [exclusive] jurisdiction:

(1)   [For] CONSISTENT WITH THE PROVISIONS OF
ARTICLE 21, FOR planning, developing, constructing,
acquiring, financing, and operating the transit facilities
authorized by this title; and

(2)  Over the services performed by and the
rentals, rates, fees, fares, and other charges imposed for
the services performed by transit facilities owned or
controlled by the Administration.

7-403.

[(a) This section does not apply to contracts for
professional services or the services of employees.

(b)  (1) The Administration shall advertise and award on
sealed bids to the lowest responsible bidder:

(i) Each contract costing over $10,000 for
the construction, reconstruction, or improvement of any
transit facility; and

(ii) Each contract costing over $5,000 for
the purchase of supplies, equipment, and materials.

(2) For these contracts, a notice requesting
bids shall be published:

(i) In a manner reasonably likely to
attract prospective bidders;

(ii) At least 10 days before the bids are
to be received; and

(iii) In at least two newspapers of
general circulation in the District.
