from the lowest responsible bidder when sealed bids, notice
and publication are not required by this section.

(e) The Administration may waive the provisions of
this section requiring competitive bids if:

(1)  The purchase is to be made from or the
contract is to be made with the federal or any state
government or any of their agencies or political
subdivisions or under any open-end bulk purchase contract of
any of them;

(2)  The public exigency requires the immediate
delivery of the articles;

(3)  Only one source of supply is available; or

(4)  In its judgment, it is to the benefit of the
Administration to use the services of State purchasing
offices.]

(a) With the approval of the Secretary, the
Administration may, CONSISTENT WITH THE PROVISIONS OF
ARTICLE 21, contract, lease, or otherwise arrange with any
person to grant to the person the privilege of operating, as
agent of this State or otherwise, any airport or airport
facility owned or controlled by this State.

(c) In accepting federal money under this section, the
Administration has the same authority to contract on behalf
of this State as that granted to the Administration under §
5-422 of this subtitle for federal money accepted on behalf
of a political subdivision, CONSISTENT WITH THE PROVISIONS
OF ARTICLE 21.

[6-209.

(a)  Except as otherwise provided in this section, each
contract costing $5,000 or more for the construction,
reconstruction, rehabilitation, improvement, or repair of a
project, including the dredging of ship channels and turning
basins and the filling and grading of land, shall be
performed by private industry and awarded on the basis of
the lowest responsible bid submitted in response to an
invitation for bids published at least twice in two
newspapers of general circulation in this State.

(b)  Contracts for emergency repairs required to keep
port facilities in operation or to return port facilities
promptly to operation may be awarded by negotiation, if the
negotiation involves at least three companies qualified to
undertake these repairs or, if less than three qualified
companies are available, all available qualified companies.
