subtitle for a fee of $5, if application is made to the
clerk of the court and, in addition to this sum, 25 cents to
the issuing clerk of the court. A sports crabber's license
is valid for the year in which it is issued.

(3) Only one occupant on a boat used to catch
crabs for noncommercial purposes shall be required to have a
sports [crabber] CRABBER'S license. The daily catch of the
boat shall be limited to 3 bushels per licensee.

(c) A person may not use patent tongs to catch
oysters:

(1)   [in] IN the Patuxent River above and north
of a straight line joining Sotterly Wharf and the beacon at
St. Leonard Creek; or

(2)   [in] IN the tributaries of the Potomac
River.

(u) "Person" includes the federal government, the
State, any county, municipal corporation, or other political
subdivision of the State, or any of their units, or any
individual, receiver, trustee, guardian, executor,
administrator, fiduciary, or representative of any kind, or
any partnership, [firm] FIRM, associations, public or
private corporation, or any other entity.

(c) Any person having an interest which is or may be
adversely affected shall have the right to petition the
Department to have an area designated unsuitable for surface
coal mining operations or to have such a designation
terminated. A petition shall describe the petitioner's
interest, contain allegations of fact and other supporting
data. Within 10 months after receipt of the petition the
Department shall hold a public hearing in the county in
which the area is located, after publication of the time and
place of such a hearing. Prior to the hearing any person
may intervene by filing allegations of facts with supporting
evidence. Within 60 days after such hearing, the Department
shall issue a written decision regarding the petition, and
the reasons [therefore] THEREFOR.

(c) The Department and its agents may enter on and
inspect any open-pit mining operation to determine
conditions of safety and assure compliance with the
provisions of this [subtitle] SUBTITLE, any rules and
regulations promulgated under it and permit conditions. If
