whom at least five are actively engaged in the practice of
pharmacy; and (ii) [one] TWO shall be [a consumer]
CONSUMERS.

(3)  None of the Commissioners shall be connected
with any school of pharmacy either as teacher, instructor,
or member of the board of trustees.

(4)  Two Commissioners shall be residents of the
City of Baltimore, two shall be residents of the counties of
the State, and [three] FOUR may be residents of either the
City of Baltimore or the counties of the State.

[(c)] (D) The Commissioners shall serve on the Board
for a term of five years. THE INITIAL TERM OF THE CONSUMER
MEMBER APPOINTED ON JULY 1, 1980 SHALL BE 4 YEARS.

[(d)] (E) (1) Each professional member of the Board
shall be appointed by the Governor, on recommendation of the
Secretary of Health and Mental Hygiene, from a list of
pharmacists of three times the number of vacancies to be
filled, submitted by the Maryland Pharmaceutical
Association.

(2) [Each consumer member of the Board shall be
appointed by the Governor, on] UPON THE recommendation of
the Secretary of Health and Mental Hygiene, AND WITH THE
ADVICE AND CONSENT OF THE SENATE, THE GOVERNOR SHALL APPOINT
TWO CONSUMER MEMBERS WHO:

(I)  ARE QUALIFIED TO REPRESENT THE

INTERESTS OF CONSUMERS MEMBERS OF THE GENERAL PUBLIC;

(II)  NEVER HAVE BEEN A PHARMACIST OR
PHARMACIST-IN-TRAINING, NOR HAVE A HOUSEHOLD MEMBER WHO IS A
PHARMACIST OR PHARMACIST-IN-TRAINING;

(III)  NEVER HAVE PARTICIPATED IN A RELATED
COMMERCIAL OR PROFESSIONAL FIELD, NOR HAVE A HOUSEHOLD
MEMBER WHO PARTICIPATES IN A RELATED COMMERCIAL OR
PROFESSIONAL FIELD;

(IV)  HAVE NOT WITHIN 2 YEARS PRIOR TO
APPOINTMENT NOR DURING THE TERM OF APPOINTMENT HAD A
FINANCIAL INTEREST IN AN INDIVIDUAL, ASSOCIATION,
UNINCORPORATED ASSOCIATION, CORPORATION, OR ANY OTHER
ENTITY WHICH IS REGULATED BY THE BOARD; AND

(V)  MAY NOT PARTICIPATE IN ACTIVITIES
RELATING TO EXAMINATIONS UNLESS APPROVED BY THE BOARD.

[(e)] (F) After notification of his appointment each
Commissioner shall subscribe to the oath prescribed by the
Constitution of the State of Maryland.
