SECRETARY OF HEALTH AND MENTAL HYGIENE, AND WITH THE ADVICE
AND CONSENT OF THE SENATE, THE GOVERNOR SHALL APPOINT TWO
CONSUMER MEMBERS WHO:
(I) ARE QUALIFIED TO REPRESENT THE
INTERESTS OF CONSUMERS MEMBERS OF THE GENERAL PUBLIC;
(II) HAVE NEVER BEEN A PHYSICIAN OR
PHYSICIAN-IN-TRAINING, NOR HAVE A HOUSEHOLD MEMBER WHO IS A
PHYSICIAN OR PHYSICIAN-IN-TRAINING;
(III) HAVE NEVER PARTICIPATED IN A RELATED
COMMERCIAL PROFESSIONAL FIELD, NOR HAVE A HOUSEHOLD MEMBER
WHO PARTICIPATES IN A RELATED COMMERCIAL OR PROFESSIONAL
FIELD;
(IV) HAVE NOT WITHIN 2 YEARS PRIOR TO
APPOINTMENT, NOR DURING THE TERM OF APPOINTMENT, HAD A
FINANCIAL INTEREST IN AN INDIVIDUAL, ASSOCIATION,
UNINCORPORATED ASSOCIATION, CORPORATION, OR ANY OTHER ENTITY
WHICH IS REGULATED BY THE BOARD; AND
(V) MAY NOT PARTICIPATE IN ACTIVITIES
RELATING TO EXAMINATIONS UNLESS APPROVED BY THE BOARD.
(2) [The] EIGHT members shall be physicians
practicing medicine in the State of Maryland.
(3) A majority of the members of the Board
constitutes a quorum.
(4) The members shall serve a four-year term and
may succeed themselves. EXCEPT THAT THE INITIAL TERM OF ONE
CONSUMER MEMBER SHALL BE 3 YEARS, AND THE INITIAL TERM OF
THE OTHER CONSUMER MEMBER SHALL BE 4 YEARS.
(5) In the event of a PHYSICIAN MEMBER vacancy,
the Board shall select a new member to serve until his
successor, elected at the next annual meeting of the
Faculty, to serve for the remainder of such unexpired term.
IN THE EVENT OF A CONSUMER MEMBER VACANCY, THE GOVERNOR
SHALL APPOINT A SUCCESSOR TO SERVE THE REMAINDER OF THE
UNEXPIRED TERM.
(6) The Secretary of Health and Mental Hygiene
on the recommendation of the Board of Medical Examiners may
remove any member of the Board for neglect of duty,
misconduct, or malfeasance or misfeasance in office.
(7) Members shall be reimbursed for expenses
incurred while actually engaged in the performance of their
duties in accordance with the standard travel regulations.
