BY adding to

Article 41 - Governor - Executive and Administrative

Departments
Section 59D(l), (m), (n), (p), and (t), and 59J(a)(4),

(5), and (6)
Annotated Code of Maryland
(1978 Replacement Volume and 1979 Supplement)

SECTION 1 BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 59D(m), through (o), respectively
of Article 41 - Governor - Executive and Administrative
Departments, of the Annotated Code of Maryland be renumbered
to be Section(s) 59D(q) through (s), respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland be repealed, amended, or
enacted to read as follows:

Article 41 - Governor - Executive Administrative
Departments

59C.

(b) The State of Maryland recognizes the act of
Congress entitled the "National Health Planning and
Resources Development Act of 1974" (Public Law 93-641), AND
THE "HEALTH PLANNING AND RESOURCES DEVELOPMENT AMENDMENTS OF
1979", (PUBLIC LAW 96-79), PROVIDED THAT ANY AMENDMENT WHICH
REQUIRES ENACTMENT OF STATE LEGISLATION TO BE EFFECTIVE MAY
NOT BE RECOGNIZED OR IMPLEMENTED UNTIL THE NECESSARY
ENACTMENT OCCURS.

59D.

(d) "Capital expenditure" [includes any expenditure of
funds by or on behalf of a health care facility which
involves building, renovation, or modernization projects of
the health care facility, or the purchase or lease of
equipment by or on behalf of a health care facility, or any
other expenditure which, under generally accepted accounting
principles, is not chargeable as an expense of maintenance.]
MEANS AN EXPENDITURE.;

(1)  MADE BY OR ON BEHALF OF A HEALTH CARE
FACILITY; AND

(2) (I) WHICH UNDER GENERALLY ACCEPTED
ACCOUNTING PRINCIPLES IS NOT PROPERLY CHARGEABLE AS AN
EXPENSE OF OPERATION AND MAINTENANCE, OR IS MADE TO OBTAIN
BY LEASE OR COMPARABLE ARRANGEMENT ANY FACILITY OR ANY
EQUIPMENT FOR A FACILITY OR A PORTION OF EITHER; AND

(II) WHICH EXCEEDS $150,000, INCLUDING THE
COST OF ANY STUDIES, SURVEYS, DESIGNS, PLANS, WORKINGS,
