Ch. 677

FOR the purpose of adding Carroll County to the provisions
regarding the regulation and licensure of outdoor music
festivals; and excluding college-sponsored and public
school-sponsored outdoor musical festivals from the
provisions of this Act.

BY repealing and reenacting, with amendments,

Article 56 - Licenses

Section 159(c), 159B(a), and 159E(a)

Annotated Code of Maryland

Annotated Code of Maryland
(1979 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 56 - Licenses

159.

(c) "Spectator" means a member of a gathering of 1,000
or more persons who are in attendance for the purpose of
viewing and/or hearing the outdoor musical festival. In
Washington, [and] Frederick, AND CARROLL counties,
"spectator" means a member of a gathering of 500 or more
persons who are in attendance for the purpose of viewing and
hearing the outdoor musical festival.

(D) HOWEVER, NOTHING IN THIS SUBTITLE APPLIES TO ANY
OUTDOOR MUSICAL FESTIVAL IN CARROLL COUNTY HELD OR CONDUCTED
BY ANY COLLEGE OR PUBLIC SCHOOL.

159B.

(a) For the purposes of this section, "outdoor musical
festival promoter" means every person engaged in the
business of organizing, producing or staging musical
entertainment in open spaces and not in a permanent
structure for a gathering of one thousand (1,000) or more
persons who pay a consideration or admission charge to view
and such musical entertainment. For purposes of this
section, in Washington, [and] Frederick, AND CARROLL
counties "outdoor musical festival promoter" means every
person engaged in the business of organizing, producing or
staging musical entertainment in open spaces and not in a
permanent structure for a gathering of 500 or more persons
who pay a consideration or admission charge to view and hear
such musical entertainment.
