Any police officer of any municipal corporation in St.
Mary's County, when in fresh pursuit, may follow into St.
Mary's County and arrest any person for a violation of State
law or a violation of the laws or ordinances of the
municipal corporation.]

Any police officer of any incorporated municipality in
Carroll County, when in fresh pursuit, may follow into
Carroll County and arrest any person for a violation of
State law or a violation of the laws or ordinances of the
incorporated municipality.]

602A.

(A) AS USED IN THIS SECTION, THE FOLLOWING WORDS HAVE
THE MEANINGS INDICATED:

(1) "FRESH PURSUIT" MEANS FRESH PURSUIT AS

DEFINED BY THE COMMON LAW, AND ALSO THE PURSUIT OF A PERSON
WHO HAS COMMITTED A FELONY IN THIS STATE OR IS REASONABLY
SUSPECTED OF HAVING COMMITTED OR ATTEMPTED TO COMMIT ANY
FELONY IN THIS STATE OR WHO IS REASONABLY SUSPECTED OF
HAVING COMMITTED A VIOLATION OF LAW IN A JURISDICTION OF
THIS STATE FOR WHICH THE PURSUING PEACE OFFICER HAS THE
POWER OF ARREST OR FOR WHOM THE OFFICER HOLDS A WARRANT OF
ARREST FOR A CRIMINAL OFFENSE. IT ALSO INCLUDES THE PURSUIT
OF A PERSON SUSPECTED OF HAVING COMMITTED A SUPPOSED FELONY
IN THIS STATE, THOUGH NO FELONY HAS ACTUALLY BEEN COMMITTED,

IF THERE IS REASONABLE GROUND FOR SO BELIEVING. FRESH

PURSUIT AS USED HEREIN DOES NOT IMPLY INSTANT PURSUIT, BUT
IT DOES MEAN PURSUIT WITHOUT UNREASONABLE DELAY.

(2) "PEACE OFFICER" MEANS A PERSON WHO, IN HIS
OFFICIAL CAPACITY, IS AUTHORIZED BY LAW TO MAKE ARRESTS AND
WHO IS:

(I) A MEMBER OF THE MARYLAND STATE POLICE;
OR

    

                  (II) A MEMBER OF THE BALTIMORE CITY POLICE

DEPARTMENT; OR

(III) A MEMBER OF THE POLICE DEPARTMENT,
BUREAU, OR FORCE OF ANY COUNTY;

(IV) A MEMBER OF THE POLICE DEPARTMENT,
BUREAU, OR FORCE OF ANY INCORPORATED CITY OR TOWN, EXCEPT
BALTIMORE CITY, WHICH IS A "QUALIFYING MUNICIPALITY", AS
DEFINED IN SECTION 37(A)(7) AND 39 ARTICLE 15A OF THIS
CODE; OR

(V) THE SHERIFF OF ANY COUNTY OR OF

BALTIMORE CITY AND WHOSE USUAL DUTIES INCLUDE THE MAKING OF
ARRESTS; OR
