AN ACT concerning

Law Enforcement - Peace Law Enforcement Officers' Authority
for Fresh Pursuit and Arrest

FOR the purpose of repealing provisions pertaining to fresh
pursuit and arrest by peace officers and police
officers in certain jurisdictions of this State; and
providing new provisions pertaining to fresh pursuit
and arrest by peace law enforcement officers within
Maryland.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

[602A.

Any peace officer of the City of Annapolis, when in
fresh pursuit, may follow into Anne Arundel County and
arrest any person or persons for a violation of State law or
a violation of the laws or ordinances of the City of
Annapolis, provided that if such arrest had been made within
the said city, it would have been lawful.]

[602AB.

Any police officer of any incorporated municipality in
Allegany County, when in fresh pursuit, may follow into
Allegany County and arrest any person for a violation of
State law or a violation of the laws or ordinances of the
incorporated municipality.]
