CHAPTER 617

(House Bill 949)

AN ACT concerning

Water, Wastewater, and Industrial Wastewater Works -
Employee Certification Requirements

FOR the purpose of expanding the legislative intent to
include operators and industrial operators of certain
works; defining certain terms; expanding the regulatory
authority of the Departments of Health and Mental
Hygiene and Natural Resources; expanding the authority
of the Board of Certification; requiring the use of
certain certified operators at water and wastewater
works and industrial waste-water works after a certain
date; requiring the advice and consent of the Senate to
certain Gubernatorial appointments; allowing the use of
uncertified operators presently employed for a certain
period; establishing a penalty for failure to employ
certified operators at certain works; clarifying
language; and generally relating to water, wastewater,
and industrial wastewater works.

BY repealing and reenacting, with amendments,

Section 406A

Annotated Code of Maryland

(1971 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

406A.

(a)  It is the intention of the General Assembly in the
enactment of this section to establish a certification
program for superintendents AND OPERATORS of waterworks,
waste-water works and industrial waste-water works so as to
further protect the public health and the quality of the
waste-receiving waters, and to prevent pollution.

(b)  For purposes of this section, the following
definitions shall apply:

(1) "Waterworks" shall mean those facilities
used in the procurement, treatment, storage, pumping or
