Ch. 534

(a)  Centers that are acquired, constructed, or
renovated by a county in accordance with § 710(b) shall be
operated by the county, and the director, staff, and other
employees of the center shall be employees of the county.
Centers that are acquired, constructed, or renovated by two
or more counties as regional centers, pursuant to § 710(e),
shall be operated in accordance with the agreement entered
into by the counties; and the director, staff, and other
employees of the center shall be employees of one or more of
the counties, as provided in the agreement. THE COUNTY OR
COUNTIES ARE AUTHORIZED TO ESTABLISH, DIRECT, AND IMPLEMENT
WORK RELEASE AND PRE-RELEASE PROGRAMS CONSISTENT WITH THIS
SECTION AND WITH THE STANDARDS DEVELOPED BY THE COMMISSION
AND ADOPTED BY THE SECRETARY. Centers that are acquired,
constructed, or renovated by the State in accordance with §
710(d) or (f) shall be operated by the State; and the
director, staff, and other employees of the center shall be
State employees. The county, with respect to a county
center, the participating counties, with respect to a
regional center, and the State, with respect to a State
center, may, by contract, provide for the operation of a
center by a nonpublic person, group, or agency upon terms
and conditions approved by the Secretary.

(b)  Each center, whether county, multicounty, or
State, shall have a community advisory board. [The board
shall consist of five persons, one designated by the
Commissioner, one representing the local government, and
three residents of the community in which the center is
located, these latter four persons to be selected by the
county commissioners or by the mayor of Baltimore City or
the county executive, with the approval of the city or
county council, as the case may be. If the center is a
regional one, the persons to be selected by the local
government shall be selected jointly by the local
governments of the counties comprising the region in
accordance with the agreement between the counties. If the
center is operated by the State, and the county or counties
fail to select their appointees within three months after
the location of the center is approved by the Board of
Public Works, the Secretary shall make the appointments.

(c)  The community advisory board shall meet
periodically with the director and staff of the center, and
shall be consulted with respect to the operation of the
center.] THE ADVISORY FUNCTION, COMPOSITION, AND
APPOINTMENTS OF MEMBERS SHALL BE DETERMINED BY THE LOCAL
JURISDICTION OPERATING THE CENTER.

[(d) The director and any assistant director of a
Center shall be appointed and removed as follows:

(1) If the center is a county center, by the
chief executive officer of the county government, or, in a
noncharter county, by the county commissioners, all with the
advice of the community advisory board and the advice and
consent of the Commissioner;
