Court of Baltimore City, if those amendments are adopted by
the qualified voters of this State at the General Election
occurring in November, 1980.
(b) In the primary and general elections occurring in
1982, candidates for the office of Clerk of the Circuit
Court for Baltimore City shall be nominated and elected.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect on July 1, 1980; however, this Act is
contingent on the passage by the General Assembly of House
Bill 1729 (01r3623) or Senate Bill 784 (01r0746) of 1980,
which bills propose amendments to the Constitution of
Maryland that relate to the creation of the Circuit Court of
Baltimore City. If neither of those bills are passed, this
Act shall be null and void without the necessity of further
action by the General Assembly.

AN ACT concerning
Personnel Merit System - Office of the Clerk
of the Circuit Court for Baltimore City
FOR the purpose of creating a personnel merit system for
employees of the proposed office of the Clerk of the
Circuit Court for Baltimore City and specifying the
functions of the system; providing for the appointment
and functions of a director of that merit system;
stating expressly that all employees of the proposed
office of the Clerk of the Circuit Court for Baltimore
City shall be employees of this State and subject to
certain rights and responsibilities; specifying certain
rights of those persons transferred to the new system;
providing that if a person starts employment in certain
positions that are authorized during a certain period
before the personnel system takes effect under this
Act, the person shall be a temporary employee, pending
a decision as to the disposition of the position under
the new system; exempting persons covered under this
new merit system from the State Classified Service
under Article 64A of the Code and making certain other
corresponding changes in related provisions of law;
generally relating to the transfer of certain employees
to the proposed Office of the Clerk of the Circuit
Court for Baltimore City and, in particular, to the
personnel merit system of that office and to the
structure and operation of that merit system; and
making this Act subject to a certain contingency.
