(3) IF FOR ANY REASON THE BANK COMMISSIONER IS
UNABLE TO PERFORM THE DUTIES OF THE OFFICE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first two
sentences of Art. 11, § 2 and from Art. 11, § 5.
In subsection (e) of this section, a reference to
the "powers" of the Bank Commissioner is added
for clarity. Item (1) of that subsection is new
language added to clarify the authority of the
Deputy to perform the powers and duties delegated
by the Bank Commissioner. The present reference
to the Deputy acting "during the disability" of
the Bank Commissioner is deleted as unnecessary
in light of the broad language of item (3) of
that subsection.
The provisions of present Art. 11, § 2 that
relate to clerks hired for a reorganization now
appear in § 5—606 of this article.
The last sentence of present Art. 11, § 2, which
requires the employees of the Bank Commissioner's
office to be bonded, is deleted as unnecessary
since, in fact, all State employees and officers
are covered by a blanket bond.
2-104. STAFF.
THE BANK COMMISSIONER MAY EMPLOY A STAFF IN ACCORDANCE
WITH THE STATE BUDGET.

clarity. It is supported by the several
references in present Art. 11 to the "employees"
of the Bank Commissioner.
2-105.. AUTHORITY OF SECRETARY.
THE BANK COMMISSIONER EXERCISES THE POWERS AND PERFORMS
THE DUTIES OF THE OFFICE SUBJECT TO THE AUTHORITY OF THE
SECRETARY OF LICENSING AND REGULATION.
REVISOR'S NOTE: This section is new language derived
without substantive change from the last sentence
of Art. 11, § 1.
The ninth sentence of Art. 11, § 1, which states
that the Bank Commissioner has all the powers
provided by law, is deleted as an unnecessary
statement of the obvious.
