REGARDLESS OF WHETHER AN ORDER FOR CORRECTIVE MEASURES HAS
BEEN ISSUED, THE DEPARTMENT AT ANY TIME MAY REFER AN ALLEGED
VIOLATION OF THIS TITLE OR ANY RULE OR REGULATION ADOPTED
UNDER THIS TITLE DIRECTLY TO THE ATTORNEY GENERAL FOR
APPROPRIATE LEGAL COURT ACTION, AND THIS SUBSECTION DOES NOT
PREVENT THE ATTORNEY GENERAL FROM TAKING IMMEDIATE ACTION
AGAINST THE VIOLATOR.                                             

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

(House Bill 1332)

AN ACT concerning

Commission on Medical Discipline -
Physician Resignation

FOR the purpose of providing that a physician may not resign
or surrender his license while under investigation by
or a charge pending before the Commission on Medical
Discipline without the agreement of the Commission; and
providing the Commission with the power to impose
conditions on the acceptance of the resignation or
surrender of a physician's license.

Article 43 - Health

Section 130(s)

Annotated Code of Maryland

(1971 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health
130.

(S) (1) A PHYSICIAN WHO IS UNDER INVESTIGATION OR HAS
A CHARGE PENDING AGAINST HIS LICENSE MAY NOT RESIGN OR
SURRENDER HIS LICENSE WITHOUT THE AGREEMENT OF THE
COMMISSION.

(2) THE COMMISSION MAY IMPOSE CONDITIONS IN ITS
AGREEMENT WITH THE PHYSICIAN UPON WHICH IT WILL ACCEPT THE
RESIGNATION OR SURRENDER OF A LICENSE.
