SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

AN ACT concerning

Water and Water Resources - Corrective Orders

FOR the purpose of expressly authorizing the Department of
Natural Resources to issue orders for corrective
measures concerning violations of Title 8 of the
Natural Resources Article; and specifying procedures
relating to an order.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Natural Resources

8-203.

(G) (1) THE DEPARTMENT MAY ISSUE ORDERS FOR CORRECTIVE
MEASURES TO ANY PERSON WHOM IT BELIEVES TO BE VIOLATING ANY
PROVISION OF THIS TITLE OR ANY RULE OR REGULATION ADOPTED
UNDER THIS TITLE.

(2)  THE PERSON TO WHOM AN ORDER IS ISSUED MAY,
ON REQUEST, CONTEST THE ORDER IN A HEARING BEFORE THE
DEPARTMENT. THE DEPARTMENT, BY RULES AND REGULATIONS, SHALL
ADOPT PROCEDURES BY WHICH THE HEARINGS SHALL BE HELD.

(3)  A COURT ACTION FOR VIOLATION OF THE TERMS OF
AN ORDER MAY NOT BE INSTITUTED UNLESS THE VIOLATOR HAS HAD
OPPORTUNITY FOR AN ADMINISTRATIVE HEARING. HOWEVER,
