AN ACT concerning
Continuing Care Contracts - Registration, Disclosure,
and Regulation
FOR the purpose of requiring institutions and organizations
that provide continuing care to older persons to
provide financial ownership and other information to
the Office on Aging for public use; regulating
advertising by these institutions and organizations;
prohibiting these institutions and organizations from
entering into contracts unless they meet certain
requirements and are certified by the Office;
prohibiting the diversion of funds and records from
these institutions and organizations and from the
State; prohibiting changes in charges for care
purchased in advance by one lump-sum payment;
providing rights upon rescission or cancellation of
contracts; regulating the dismissal and discharge of
subscribers; requiring the disclosure of certain
information to the older person purchasing care;
prescribing certain rights of inspection, civil
remedies, penalties, and provisions for receivership;
and generally relating to the regulation of
institutions and organizations providing such care.
BY adding to
Article 70B - Office on Aging
Section 7 through 23, inclusive, to be under the new
subtitle "Continuing Care Contracts"

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
