AN ACT concerning

Solid Waste - Definition

FOR the purpose of redefining the term "solid waste", under
Article 43, Section 387C(a) of the Code, to include
garbage, sludge, or liquid from industrial, commercial,
mining, or agricultural operations and from community
activities, but excluding certain other material.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

387C.

(a) As used in this subsection:

14. "Solid wastes" means [litter and all refuse
materials, other than gaseous and liquid wastes, from all
public and private establishments and residences, including
shopping centers.] ANY GARBAGE, REFUSE, SLUDGE, OR LIQUID
FROM INDUSTRIAL, COMMERCIAL, MINING, OR AGRICULTURAL
OPERATIONS AND FROM COMMUNITY ACTIVITIES, BUT DOES NOT
INCLUDE SOLID OR DISSOLVED MATERIAL IN DOMESTIC SEWAGE OR IN
IRRIGATION RETURN FLOWS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
