CHAPTER 219

(House Bill 1303)

AN ACT concerning

Arson and Burning - Trash Containers

FOR the purpose of providing it is unlawful to set fire to,
burn, or attempt to burn the contents of any dumpster,
trash container, or recepticle receptacle; and
specifying penalties for these offenses.

BY adding to

Article 27 - Crimes and Punishments

Section 9A

Annotated Code of Maryland

(1976 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

9A.

(A)  A PERSON MAY NOT WILLFULLY AND MALICIOUSLY SET
FIRE TO, BURN, OR ATTEMPT TO BURN THE CONTENTS OF ANY
DUMPSTER OR ANY OTHER TRASH CONTAINER OR RECEPTICLE
RECEPTACLE BELONGING TO ANOTHER PERSON.

(B)  A PERSON CONVICTED OF VIOLATING THIS SECTION IS
GUILTY OF A MISDEMEANOR AND IS SUBJECT TO BE FINED UP TO
$500 OR IMPRISONED FOR A PERIOD UP TO 30 DAYS, OR BOTH FINED
AND IMPRISONED IN THE DISCRETION OF THE COURT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
