Ch. 304
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 2B - Alcoholic Beverages
75.
(a) EXCEPT IN BALTIMORE COUNTY, -[-On the tenth day-]-
180 DAYS after the holder of any license issued under the
provisions of this article [shall have] HAS vacated, or been
evicted from the premises for which the license was issued,
the license shall expire unless an application for approval
of a transfer [thereof] to another location or assignment to
another person pursuant to § 74 of this article or an
application pursuant to § 78 of this article has been
approved or is then pending. --[-However, the official
authorized to issue licenses, in his discretion, may
postpone the expiration for an additional period not
exceeding 20 days in any case to avoid undue hardship.
(b) This section does not apply to the holder of any
license whose premises have been acquired for public use.
(c) The license for a premises acquired for public use
shall expire within 180 days of acquisition unless an
application for approval of a transfer of the license to
another location or assignment to another person pursuant to
§ 74 of this article or an application pursuant to § 78 of
this article has been approved or is then pending.-]-
(D) IN BALTIMORE COUNTY, 180 DAYS AFTER THE HOLDER OF
ANY LICENSE ISSUED UNDER THE PROVISIONS OF THIS ARTICLE HAS
VACATED, OR BEEN EVICTED, FROM THE PREMISES FOR WHICH THE
LICENSE WAS ISSUED, THE LICENSE SHALL EXPIRE UNLESS AN
APPLICATION FOR APPROVAL OF A TRANSFER TO ANOTHER LOCATION
OR ASSIGNMENT TO ANOTHER PERSON PURSUANT TO §74 OF THIS
ARTICLE OR AN APPLICATION PURSUANT TO §78 OF THIS ARTICLE
HAS BEEN APPROVED OR IS THEN PENDING.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.
