Department revise or repeal certain rules under certain

BY repealing and reenacting, with amendments,

Article 41 - Governor - Executive and Administrative

Departments
Section 221C(b)
Annotated Code of Maryland
(1978 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 41 - Governor - Executive and Administrative

Departments

221C.

(b) The Secretary of Licensing and Regulation shall
be responsible for promulgating rules and regulations for
his office.

(1)   [He shall] THE SECRETARY MAY review [and
shall have the power to], approve, disapprove or revise the
rules and regulations pertaining to the administration or
the administrative and operational procedures, including
budget-making, purchasing, employment, and licensing forms
of all of the divisions, boards, commissions, offices, and
other agencies within the jurisdiction of the Department [of
Licensing and Regulation and no]. NO such rule or
regulation [shall be] IS effective until approved by the
Secretary. [Nothing herein shall be construed to authorize
or require the Secretary of Licensing and Regulation to
review, approve, disapprove or revise any rule or regulation
of any of the divisions, boards, commissions, offices, and
other agencies within the jurisdiction of the Department of
Licensing and Regulation when such rule or regulation
pertains to the regulatory, supervisory, quasi-judicial,
disciplinary or enforcement duty or function of such
division, board, commission, office, or other agency.]

(2)      PRIOR TO PUBLICATION PURSUANT TO SECTION
245 OF THIS ARTICLE, THERE SHALL BE SUBMITTED TO THE
SECRETARY MAY DISAPPROVE ANY PROPOSED RULE OR REGULATION OF
ANY OF THE DIVISIONS, BOARDS, COMMISSIONS, OFFICES, AND
OTHER AGENCIES WITHIN THE JURISDICTION OF THE DEPARTMENT
WHEN THE RULE OR REGULATION PERTAINS TO THE REGULATORY,
SUPERVISORY, QUASI-JUDICIAL, DISCIPLINARY OR ENFORCEMENT
DUTY OR FUNCTION OF SUCH DIVISION, BOARD, COMMISSION,
OFFICES, OR OTHER AGENCIES IF THE, THE SECRETARY MAY, WITHIN
