(2) THE SECRETARY, WITH THE APPROVAL OF THE
BOARD OF DIRECTORS, MAY DELEGATE TO ANY OTHER OFFICER OF THE
SERVICE THE DEPUTY DIRECTOR, DURING AN ABSENCE OF THE
SECRETARY, ANY DUTY ENUMERATED IN PARAGRAPH (1) OF THIS
SUBSECTION.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

AN ACT concerning
Water Permits - Notices and Hearings
FOR the purpose of deleting, from the provisions for action
on permits for appropriation or other use of water,
modifying the requirement for public notice of the
application and for mandatory hearing; enabling the
Department of Natural Resources to publish certain
notice of a tentative decision and an opportunity for
hearing; requiring the scheduling and public notice of
a hearing, on request; specifying the manner in which
certain hearings shall be conducted; and enabling
action without a hearing after a certain time.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article - Natural Resources
8-806.
(a) Except as provided otherwise in this section,
within one month after THE filing OF A COMPLETE AN
application for a permit [ to appropriate or use any waters
of the State, construct or reconstruct a reservoir, dam, or
waterway obstruction, construct a waterway, or dredge, fill,
bulkhead, or change the shoreline] AS REQUIRED BY THIS
