AN ACT concerning

Board of Building, Savings and Loan Association - Appeal of

Final Orders

FOR the purpose of providing that the Administrative
Procedure Act governs certain appeals from final orders
of the Board of Building, Savings and Loan Association
Commissioners.

BY repealing and reenacting, with amendments,

Article 23 - Miscellaneous Companies

Section 161H(e)

Annotated Code of Maryland

(1973 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 23 - Miscellaneous Companies

161H.

(e) The [court to which the] appeal [is] taken shall
[hear the matter de novo, without a jury, and the parties
may call such witnesses and introduce such evidence as may
be proper in the premises.] BE SUBJECT TO THE PROVISIONS OF
THE ADMINISTRATIVE PROCEDURE ACT. An appeal may be taken
from the decision of the court hearing said appeal to the
Court of Special Appeals by any party to the proceedings in
the same manner as other appeals are taken from decrees or
orders of courts.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.
