reclassification, by repealing and re—enacting with
amendments subsections (a) and (b) of Section 22—22, Article
III. Zoning, title "Planning, Zoning and Subdivision
Control" of the Baltimore County Code, 1968, as amended, by
redesignating subsection (j) as new subsection (k) of said
section, article, title and code and by adding new
subsections (j) , (1), (m) and (n) to said section, article,
title and code.
WHEREAS, the rezoning of property is permitted when it
is shown that there is a mistake in the original zoning or
comprehensive rezoning or a substantial change in the
character of the neighborhood, the basis for such rezoning
being known as the "change—mistake" rule; and
WHEREAS, frequent interpretations of the
"change—mistake" rule have allowed rezoning, even though the
rezoning may not be consistent with public policy; and
WHEREAS, there is a need for legislative guidelines
upon which to base the granting of rezoning petitions; and
WHEREAS, the County Council has received a final report
from the Baltimore County Planning Board, and has held a
public hearing thereon recommending the adoption of
legislation to clarify the use of the "change—mistake" rule
in determining whether or not to grant a zoning
reclassification and to specify the factors to be considered
in making such determinations; and
WHEREAS, the County Council has found that the adoption
of the legislation referred to herein is in the best
interests of the c5.tizens of Baltimore County; now,
therefore
