Re: House Bill 825
Dear Governor Hughes:
He have reviewed House Bill 825, a bill concerning an
exclusion from unemployment benefits for certain employees
of educational institutions. However, because of a
defective title, we do not approve the bill.
As passed by the General Assembly, the bill retains the
present law of Art. 95A, Sec. 4(f)(4) which excludes certain
employees of educational institutions from unemployment
benefits for the period between academic terms or years if
there is a reasonable assurance that the employee will be
employed during the succeeding term or year. As passed by
the General Assembly, the bill adds a requirement that
before July 1 of each year each educational institution is
to provide the Employment Security Administration with the
name and Social Security number of each individual who has a
reasonable assurance of continued employment.
It is apparent that the new language does not alter the
exclusion, but simply provides the Administration with
information for enforcing the existing exclusion. However,
as the title of the bill refers to "altering" the exclusion,
it is our view that it does not fairly advise the reader of
the subject of this bill, as required by Art. III, Sec. 29
of the State Constitution. Baltimore Transit Co. v.
Metropolitan Transit Authority, 232 Md. 509, 521 (1963).
